OVERVIEW
This website, www.yuwen.jp (the "Site"), is operated by FOURGRACE CO., LTD., trading as YUWEN ("YUWEN", "we", "us", "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), together with our Shipping Policy, Refund Policy and Privacy Policy, which are incorporated by reference. If you do not agree, please do not use the Site.
We may update these Terms by posting a revised version on this page. Continued use of the Site after a change constitutes acceptance of the revised Terms. Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell to you.

SECTION 1 – WHO MAY USE THE SITE
By using the Site you confirm that you are at least the age of majority where you live, or that you are using the Site with the consent of a parent or guardian. You may not use the Site or our products for any unlawful purpose, and you must not transmit viruses or other destructive code. Breach of these Terms may result in termination of your access.

SECTION 2 – PRODUCTS, PRICES AND DUTIES

Prices are displayed in the currency of your selected market. Prices for France are displayed in euros (EUR); prices for the United States are displayed in US dollars (USD).
For orders shipped to the United States, US import duties are included in the price displayed; nothing further is charged on delivery. For other destinations, duties and taxes levied on arrival are the responsibility of the recipient unless stated otherwise at checkout. Shipping charges are calculated at checkout and shown before you confirm your order.
Prices and product availability may change without notice. We reserve the right to limit quantities, to decline or cancel any order, and to correct errors in pricing or product information, including after an order has been placed. If we cancel an order, we will notify you and refund any amount paid.
Every product we sell is made in Japan. Many are made by hand: small variations in glaze, color, shape and size between individual pieces are characteristics of the work and not defects. We take care to photograph products accurately, but colors may appear differently on different screens. Dimensions are given on each product page in centimeters and inches.

SECTION 3 – ORDERS AND PAYMENT
You agree to provide accurate, complete and current purchase and account information. Payment is taken in full at the time of order through the payment methods offered at checkout. We may limit or cancel orders that appear, in our judgment, to be placed by resellers or that fail our fraud checks. If we change or cancel an order, we will attempt to notify you at the email address provided.

SECTION 4 – SHIPPING
Orders ship from Tokyo by tracked international post. Dispatch times, transit estimates and packing standards are set out in our Shipping Policy. Transit estimates are not guarantees; customs processing and carrier delays are outside our control. Risk of loss passes to you on delivery. If a parcel arrives damaged, the procedure in our Refund Policy applies.

SECTION 5 – RETURNS AND REFUNDS
Damaged, defective or incorrect items are replaced or refunded in full when reported within 14 days of delivery with photographs, as described in our Refund Policy. Returns for change of mind are accepted within 30 days of delivery, unused and in original packaging, as set out in our Refund Policy; return shipping is at the customer's cost. Nothing in these Terms affects any statutory rights you may have under applicable law.

SECTION 6 – INTELLECTUAL PROPERTY
All content on the Site, including text, photographs, product descriptions, logos and design, is owned by or licensed to YUWEN and protected by copyright and trademark law. You may not reproduce, copy, sell or exploit any part of the Site or its content without our written permission.

SECTION 7 – PROHIBITED USES
You may not use the Site: (a) for any unlawful purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame or discriminate against anyone; (e) to submit false or misleading information; (f) to upload malicious code; (g) to collect personal information of others; (h) to spam, phish, scrape or crawl; or (i) to interfere with the security or operation of the Site. We may terminate your access for any violation.

SECTION 8 – THIRD-PARTY LINKS AND TOOLS
The Site may contain links to third-party websites or use third-party tools that we do not control. We are not responsible for their content, accuracy or practices, and any use of them is at your own risk. Please review the relevant third party's terms and policies.

SECTION 9 – REVIEWS AND SUBMISSIONS
If you send us reviews, comments, photographs or other material ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide license to use, edit, publish and translate them in any medium. You confirm that your Submissions are yours, do not infringe any third party's rights, and are not unlawful, abusive or misleading. We may remove any Submission at our discretion.

SECTION 10 – PERSONAL INFORMATION
Your personal information is handled in accordance with our Privacy Policy.

SECTION 11 – ERRORS AND OMISSIONS
Occasionally information on the Site may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct such errors and to update information or cancel affected orders without prior notice, including after an order has been submitted.

SECTION 12 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that use of the Site will be uninterrupted, timely, secure or error-free. Except as expressly stated in these Terms or our policies, the Site and the products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.
To the maximum extent permitted by law, YUWEN and its directors, officers, employees, agents, contractors and suppliers shall not be liable for any indirect, incidental, special, punitive or consequential damages, including lost profits or lost data, arising from your use of the Site or any product purchased through it. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned. Some jurisdictions do not allow certain limitations, in which case our liability is limited to the maximum extent permitted by law.

SECTION 13 – INDEMNIFICATION
You agree to indemnify and hold harmless YUWEN, its affiliates, officers, directors, employees and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 14 – SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law and severed to the extent it is not, and the remaining provisions shall remain in full force.

SECTION 15 – TERMINATION
These Terms remain in effect until terminated by you or by us. You may stop using the Site at any time. We may suspend or terminate your access without notice if we believe you have breached these Terms; obligations incurred before termination survive it.

SECTION 16 – ENTIRE AGREEMENT
These Terms and the policies referenced in them constitute the entire agreement between you and YUWEN regarding the Site and supersede any prior agreements or communications. Our failure to enforce any provision is not a waiver of it. Ambiguities shall not be construed against the drafting party.

SECTION 17 – GOVERNING LAW
These Terms and any separate agreement under which we provide products or services to you are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, without prejudice to any mandatory consumer protection rights you may have where you live.

SECTION 18 – CHANGES TO THESE TERMS
The current version of these Terms is always available on this page. We may update, change or replace any part of them by posting changes here. Your continued use of the Site after changes are posted constitutes acceptance of those changes.
